Non-Commercial Print License

$0.25

“What is this and who is it for?”

This non-commercial print license gives the holder the right to lawfully make one “counter-copy” in whole or in part for every original print of BEAM sheet music in the owner’s library as allowed by the purchased volume of this license. Under this license, copies in whole or in part are permitted for only the following reasons: to make page turns easier, to make guilt-free mark-ups for practice, to protect the originals from neglect, or to have every page plainly visible throughout the course of a song.

If this sounds like something you would use (because maybe you do these things anyway), then our non-commercial print license is for you!

“Why does this exist?”

Normally, photocopying sheet music for any reason is outright forbidden by publishers. Like any other publisher, BEAM will do whatever it takes to protect its rights, its property, and its artists, but unlike any other publisher, we have drafted a conditional non-commercial print license to bring relief to those who would prefer to have a clean conscience and keep their extramusical use of printed music materials aboveboard.

Please use the included calculator to determine your organization’s maximum use and the cost to license your use. Note that any counter copies from a previous license period may be retained for future use at no additional cost, providing none of them are used during the current license period and the minimum cost of $2.00/period has been paid to keep your license current and in good standing. Continue reading to understand the terms and conditions below.

Terms and Conditions

-The license holder is permitted to make fractional or whole counter copies of as many pieces of BEAM sheet music as they own and their purchased license to copy allows.
-Fractional counter copies are partial reproductions of an original defined by BEAM as being between one page to half of the score in size.
-Whole counter copies exist as complete photocopied reproductions of the original score.
-Reproductions of the score in amounts between half and whole are forbidden.
-Whole counter copies are to be used as substitutes for their originals to provide the freedom to manipulate or even damage the printed work to make practice and play easier without the worry of destroying the original print.
-Originals substituted with whole counter copies must remain accessible but stored away as originals must not be in circulation at any time its whole counter copy is in circulation. BEAM refers to the practice of using both the whole counter copy and its original print as “double dipping”. (In short: No double-dipping!)
-Whole counter copies may be kept for use years later providing this license remains current and in good standing.
-Volume of counter copies in possession must not exceed the volume of original prints owned year over year; destroy all counter copies in excess of owned originals.
-Fractional counter copies are to be used as convenience pages for practice, gratuitous mark-ups, or easy page-turns.
-Fractional counter copies may be in circulation at the same time as their original as long as they are kept together.
-Fractional counter copies must be destroyed once their usefulness is outlived.
-The cost of this conditional license is 25¢/counter-copy-in-use/year to be paid up-front.
-This volume-centric license has a minimum cost of $2.00 to acquire or to annually renew so that it remains current and in good standing. Renewal must occur BEFORE the current license’s expiry date.
-Your organization’s music librarian is responsible for the tracking and accounting of every counter copy made or used throughout the year.
-This license is for a fifteen month period from June 15th of the current year to September 15th of the following year and becomes available for purchase May 1st of the current year.
-This license is volume-centric and use dependent, which means your annual cost is determined by the maximum quantity of counter copies you plan on using (or to put into circulation within your organization) during the license period. - Minimum purchase quantity: 8
-Failure to renew this non-commercial print license in any way is an agreement to immediately destroy all counter copies (yes, every last one). A notice of acknowledgement must be sent to our company email (BEAM@BehnyEAM.com) prior to 30 days past this license’s expiration with a statement detailing the number of counter copies destroyed and for what songs. Failure to acknowledge expiration of this license, willful or not, without self-renewal will result in an $8 administrative renewal charge ($2 renewal, $3 processing, and a $3 penalty for lack of adherence. Failure to acknowledge expiration of this license two years in a row may result in legal action.
-We reserve the right to terminate this license if we suspect violations of these terms.

Example #1 (1st year) There are thirty students with two BEAM songs each, but five students are gentle with their music and will not need counter copies, but your librarian reports four more copies were made throughout the year to replace lost/damaged counter copies; the next year (2nd year) goes by without a performance of music made by BEAM, but in the following year (3rd year) there are now three songs for twenty-five students overall with still five that are gentle and no replacements are made by the end of that year: this will cost $12.50/1st year, $2.00/2nd year, and $15.00/3rd year. Assuming an average cost of $4.50/original, that comes out to an average of about $10/year to protect over $300 worth of music, guilt free.

Example #2: You’re an independent pianist and you have four works from BEAM. You would rather spread your song out from end to end in practice and maybe in concert as well. Your cost is $2 for the year to make up to four copies. If you acquire four more (to make eight), you cost to have counter copies of every work is still just $2 for the year. Say you have ten works; that’ll be $2.50 for the year.
